I was planning on filing chapter 7 thinking that all of my back taxes could be discharged. They total $17,000 (I have been on a payment plan and paid them down from $41,000, but am now on medical disability and cannot afford to continue paying them $655 a month) I was planning on filing individually, but found out that although 1992. 1996 and 1997 were filed individually that 1999 and 2001 were joint, so that would come after my wife. I also just found out that the $4700 of the individual have a lien against them until 1/25/06. Thus they are not dischargeable under chapter 7 and if I make the payments until then (I am 2 months in arrears) I will have to pay them at least $4585 and would be filing under the new law.
Two questions
If I filed a chapter 13 rather than 7 would my taxes under the lien be included?
Could the taxes filed jointly be covered by an individual 13, or would they still go after my wife for collection of those.
I thought I had this all figured out and now I'm panicking. Thanks for any help.
