    I may be screwed?? Help

    My husband and I have been preparing to file BK7. We are obviously behind on our cc's and his mother is a co-signer. Well, the creditor called her and she has impeccable credit, so she paid it off ($1300) to save her credit.
    Well now I'm afraid that he may not be able to file since such a large amount was paid.
    But technically, when asked on the forms if we have paid more than $600, can't we put no since technically WE didn't pay it? There is no way we could have paid it and we have proof, we couldn't even get it up to date for $114.
    Please advise. We need to file asap

    I dont think they would hold that against you seeing as how you didnt pay it yourself. As long as you can prove you didnt pay it.

      I would put no, (and not list that creditor at all), if someone else paid it....but I am no expert.

        You should be ok. When they ask you on your statement of financial affairs who was paid $600 or more in the 90 days prior to filing you can say no and be honest since you didn't pay. They will check your bank statements and as long as there are no checks written in the amt of $600 or more you should be fine.

          My ex paid off two shared credit cards - I listed them on the petition and just put "co-signer paid off" and my attorney said that it was fine.
