    Odd private loan situation.

    Hello about 2 years ago me and my wife were in a pretty poor living situation while she was in nursing school. We decided to take out a living expense loan with bank of america for about 15K.

    Well recently my wife went on maternity leave and since she works nights it cuts 20% of her wages. Among other things the last two months its been tight and we didn't make the living expense loan payment. So were like 35 days behind on the payment and we get a letter from NCO saying were in collections for just the minimum amount due. The loan was originally through bank of America and then it was transferred to AES. I'm confused because now NCO is in the picture? We tried to defer it and to get a forbearance but it keeps saying were not eligible.

    NCO is also in control of our soon to be discharged AMEX account. It says in the letter to pay AES but they are handling the collections on the account? Does AES just outsource past due accounts to NCO? Im also concerned this is some kind of weird tactic to get us to pay our Amex account with them.

    From personal experience...

    I wouldn't send NCO a dime if they gave me the dime to send back to them. NCO is a bunch of crooks that will do anything and everything you can imagine to get you to send them money. Be prepared for calls to relatives, neighbors, etc. I would send them a C&D letter or they will hound you, your relatives, your work, and your neighbors to no end.

    Been there, done that.

      Ive already spoken with them once regarding the Amex account. The guy right off the bat started threatening me, I just laughed and gave him my attorneys information and hung up. Haven't heard from them since. Now im concerned tho that im going to have to deal with them on a daily basis regarding this private school loan that im pretty sure is not dis chargeable. Does anyone know if some student loans are dischargeable? I would assume this loan would be similiar to a student credit card or something like that?

          Yeah i just looked into it more, I knew that like 99% were not. Just wishful thinking i guess. I did find out some more information and i guess there are some options available to us. We got out very very lucky with student loans, only have that one 15K loan and a 1200$ one. Once were done with bankruptcy we will only have our car payment and those 2. Im not going to complain about that. Thanks all.
