    Help me decide bk vs cccs

    Ive been on and off these boards for a while. I had some negatives and with the help of this website I was achieving higher credit scores. But I lost my job in July. I still get a partial pay from a fund my employer has set up, but its no where what i was making. In fact, I based alot of my life on a little bit of overtime.

    So, I understand where I went wrong, what i could've, should've done different, But that is in the past. my scenario is this, I can file ch7 now. I make almost exactly the median income for my state. I just worry about my home. I know there are exemptions and Im sure i fall in the exempt category. Home balance is $174,000, worth about the same. OR...I know im gonna get flamed for this, but I could call CCCS. I know it goes on my credit report negatively, but at least there wont be anymore phone calls, and maybe, just maybe, It wouldnt be as bad a bankruptcy..right?

    In the past I negotiated with a creditor myself, even though it took almost a year before they would talk to me, it worked in the end. Should this be something I try with all my CC's? I couldnt imagine the phone calls I would be blocking and dodging. A few of them just told me I wasnt far enough behind to negotiate yet.

    At this point there will be no extra income until I am either recalled or transfered, both of which are dependent on a good economy.

    “ramstang”: Understand this is only an opinion. I don’t know what you did or didn’t do on the job that you no longer have it. It was quite clear what you said. Is it possible or not to go back to the employer and ask for a second chance?? That being said, if you are going to depend on the economy, better get into line right now for 7. The line is getting longer. The times are going to get tougher. It is my opinion if you are convinced you cannot recover, STOP paying the CC, and go to a good bk lawyer. Let me say, good ones are hard to find but that is also an opinion. Please keep reading here. You will see many stories. As they come about, you will see your own story. ‘Hub

      When you say CCCS, are you referring to Consumer Credit Counseling Services? If you are then you can be certain that BK is a better way to go. In any case you will have to get credit counseling to file for BK anyway, and it will probably be CCCS that you will go to. Then you will get a much better idea of what's going on.

          If you decide not to file BK, you can negotiate the debt yourself. I would not go through a credit couseling agency. Research carefully as there are many things to consider including paying income tax on the forgiven debt.

          If you have plenty of cash and are insolvent, negotiating with the creditors is not a bad option if you absolutely do not want to or cannot file BK.

            LOL Read the last sentence of his post. I don't know what is "clear what he said" to you, but I don't think this poor guy got fired.
