We have retained a lawyer in full to file Chap. 13. No, we are not behind on our mtg or car pmts. It is just ALOT of CC bills and medical bills.
I have had 1 judgement just granted against me on 1 cc, the rest we have "held off" so far.
Anyway, we are involved with a wrongful death lawsuit of our 25 yr old son. This Jan. will be 2 years since the lawsuit was filed. FINALLY this month and last depositions took place and Dec. is end of discovery period.
We would like to think after that, that this case will be wrapped up within the first qtr of the year.
IF there is anything of course our plan was to pay off all creditors (at a reduced rate)
Do we file the 13 now since there are no promises, or do we try and stave off the wolves even further? Stopped paying all CC's in Feb.
I know if there is a judgement in our favor or an offer made, the money we receive will go to the Trustee...so not real sure it matters when we file or not.
