    American General Furniture...victims?

    I know there are a few of us out there...we had refused to sign a reaff w/them when we filed, and our atty expressed serious doubt they'd ever truly come for the furniture. The re-aff was for the full amount (in the neighborhood of $2100, I think, but the amount put on the forms when we filed of its worth was around $500) A month ago we received a mssg from Am General, and never returned it. I emailed our atty, who said again they doubted they would attempt anything, especially since a reaff was never signed or anything filed with the court..WELL, just a minute ago I got a mssg from someone saying they were from "Global Services" for American General, with a PICK UP order for us!! Holy crap----are they SERIOUSLY planning to come and get this stuff? We were discharged on 10/14...I am so upset--has anyone else experienced this?

      Thanks so much for your reply, 'hub!! As always, your posts make me laugh and smile...I really can't find anything under the 800# they left, or anything by that rather lame "Global Services" name..It dawned on me that we've moved since filing (gave up the house) so, hmmm..if we never call them back will they just drive over and hang out at our old house, hoping to find us and our furniture? haha...you are so right, what on earth would they do with it now? I've mentioned in previous posts, I'm a mom--this furniture, though pretty, has been barfed on, pee'd on, drooled on...etc, etc...ewww, when I put it that way, maybe they'd be doing me a favor to pick it up, huh??

        Martha, Bigboy is right. First, they cannot step upon your property without a sheriff or bailiff there. Secondly they better have serial numbers or pictures of what your furnature was. Third, anything they take you can probably replace at a goodwill store. American General is mean. They attempted to stick our Trustee with a reaffermation and at our 341 he asked do you intend to sign this? I looked at it and said not at all and I never got this. He said yes he got it and handed it to me. It was a cheap shot that they thought under stress we would seem to be forced to sign it. Two valiums on the 341 and I was not stressed to sign anything.           BigBoy, thanks, I like that part, although I'm feeling very wimpy about talking to anyone. Will let the DH do it--it's in his name only anyway! We did indicate "surrender" on the original filing, so you are saying in order to get us to actually surrender it they'd have to file something with the court? (like they did in the case of the cars, which we voluntarily returned anyway). Wow--that would be amazing if they went to those lengths. Can they even do that now that the case is discharged?

            Martha if you wish to willingly surrender the stuff, put it in the yard on any certain day and let them pick it up. I doubt anything will come of this. To me it is tantamount to using another person's underwear. 'Hub

              Hi Martha!

              I am an American General Furniture victim!!!

              When we filed, our attorney also listed that we would reaffirm. When we got the papers, the amount was for the original loan amount, not the depreciated value, so we didn't sign.

              We were discharged in July and we NEVER heard anything from American General....and they have our address, our phone number. BUT, our original loan amount was for $1000. I worried because we bought the furniture in December/January and we filed in March. It was still pretty new furniture.

              Martha, what you have to remember is you DO NOT let them come into your home and remove your furniture without a WARRANT. To get a warrant takes time and money. When all is said and done, it won't be worth it for them to come get their furniture, especially if it's used.

              I like what the PP said. If it comes down to it, I would say you sold it. It's a discharged debt.

                I wouldn't reply to them whatsoever. Anything you say will be used against you, and only perpetuate matters. If you do happen to answer the phone with them, just hang up. Ignore them. If something with official legal paperwork comes from this, that is when you will answer through the proper channels, ie. court, lawyer, police, etc. Letters, phone calls, emails, don't count as anything.

                  Man, this is wracking my nerves..that "Global Services" with the "pick-up" order just called again and left another mssg..sounded a little annoyed. I wonder if they are thinking with the impending holiday we'll call to work something out since we sure need our furniture, my parents are coming tomorrow for goodness sake! Ugh. I did email our atty and basically he just replied that they do have the right to the furniture since we'd indicated surrender in the bk paperwork, but he didn't say how they can enforce it-he just said we can attempt to redeem it w/them by working something out..crud..I was really just hoping they would go away, now I'm back to not wanting to answer my phone again, even though we're discharged. Do they REALLY need some type of court order to come and get it??
