    GMAC Issue?

    Received an alert from Equifax today regarding a new negative item on my credit report.

    Looked at the report and GMAC shows my Account as Delinquent 11/2008 and "Pays As Agreed" now shows "Included in Bankruptcy"

    This does not make any sense to me? It would make sence if we were a Chapter 13 but this is a Chapter 7 and my account with them is current. November payment was made just last week and cleared so its never even been late at any time including now?

    Once they get your matrix and letter of bk, it is probably a one keystroke entry that would automatically state delinquent. However the Paying as agreed is what is important. Now the the stay is on, they will not bill you, so keep up with the payments for pay through. You may reaffirm but pay through is better. 'Hub

      Spoke with GMAC and they said they would correct everything once we sign our reaffirm agreement and change it to "Pays as Agreed" once I send them the discharge papers when we eventually get them. They said they mailed it to my lawyer on Monday so I guess I will get it soon. This vehicle has $4000 in equity and we only owe $13k so we are going to reaffirm it.
