My wife and I just filed for chapter 7 on 11/19/08. Tonight we found a mistake on our part. This has been a very hectic and stressful time in our lives leading up to our BK. We are now sitting here reviewing all this paperwork preparing for the 341 and realized that there is an ommision on our petetion. In June my wife received a settlement from a car accident where she was not at fault. The settlement was for six grand and some change. Due to lots of confussion and BS associated with everything we are going through we didn't list it on the BK.
I drive over the road so my wife has been doing this all by herself and as hokey as it may sound we just didn't remember it until tonight.
My first question is how do I tell my attorney about it without her thinking we were trying to hide it and getting pissed at us and dropping us?
My second question is since we are just now disclosing it after filing the petetion, are we going to have trouble with the trustee assigned to our case?
We have factored the 6 grand in on our own and it doesn't even put us close to failing the means test.
