Well, everything was going smoothly until today. I had been using the 400/month that I would normally use towards property taxes to pay my lawyer and then once I'm discharged and have my tax refund would go towards the past property taxes. I didn't do the escrow thing, I was responsible for paying them on my own.
Got a letter in the mail today that they are going to FORCE taxes on me for this past year and the upcoming year if I don't pay my taxes by 12/19. I called the lender and *****ed about it and they say there is nothing they can do they are just protecting their interest in the property. It's understandable, but I knew things were going too smoothly. I had a plan to get current by march and then even be current for next years as well, but to them this is unacceptable.
My question is, can they just change my amount like that? It's probably somewhere in the fine writing but still, I don't see how this can totally be legal. That's raising my mortgage by 800 a month, ridiculous.
My other thing is I am going to be filing either 12/16 or 12/17, then I am protected by the automatic stay. If they haven't forced it then, I can send my normal mortgage payment until discharge and be fine right? Then by the time I'm done and discharged can't I just pay the past ones and be done with that? It's a good plan in theory but will it work?
