I am in upstate NY and wanting to file Chap.7. Does anyone know what the average fee and attorney will charge to take my bk?

I live in NY too. My atty fee is $1050, $299 filing fee, $35 credit report, $100 two bk courses. Hope that helps.

At this time of year, most people will start a payment plan to start building equity toward their attorney fee, and then use their tax refund, or they will often borrow from family or friends.

Can't the trustee ask for your refund at the 341?

If you have spent it on paying your attorney, which is an acceptable expense, they have nothing to go after. They can ask about it and you can reply that you used it to pay the attorney for the BK.
