Means Test

Hello All,
I will finally be filing next Friday. We are over the means test by about $800 per month but our attorney sees no problem in doing a chapter 7. We are in California.

My question is, at what point in the timeline is it decided if we do qualify for chapter 7? Who will tell us? I am assuming it is sometime between when we file and our 341.

For the most part, you are correct...if the UST has an issue with your filing you will hear from them between filing and your 341. In some cases the UST will show up at your 341 to ask questions, request documentation, etc.

Are you showing $800 disposable income every month on your means test?

Not $800 in disposable income......$6,400 in income allowed for a family of 4 in CA and ours is $7,200.
