    adversary complaints

Has anybody here in the forum had filed CH 7 and experienced a adversary complaint from one of the creditors? What Happend? How did it turn out?

Why do you ask? Have you done anything that may cause them to dispute it? Your atty can't tell you if they will or won't but they can tell you your "chances" of something being disputed. The most common one is if any charges were made close to filing, how large were they and were they luxury items.

Yes I have had an "aversary complaint" in a Chapter 7.....

Mine was filed by the trustee to take my MH from me (after bad title was found) and to take the "interest" the mortgage company thought that had in it.....mortgage company failed to record their lien. (thus they lost their financial hold on the MH)

I had my MH taken from me without a fight - because there was no lien recorded against it - SO IT BECAME A ASSET TO ME!!!

I could not prove the mortgage company had a lien on it - which they were "supposed to have".....

You didn't say what YOUR complaint was for???? Or what creditor it was.....? And what was it about? Maybe we can help.................maybe not.

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.
