    Will they consider this abuse?

    About 2 months ago I visited a dentist because of major dental problems I was having. The procedures cost around $20,000 and I was given credit by Chase health. Well long story short, this was an addition to almost $150,000 in credit card and credit lines that I had racked up trying to save a failing business. ( By the way my credit was flawless until about 3 months ago) I have now decided to file Chapter 7 bankruptcy to start my life over. I have learned a HUGE lesson.

    I plan on filing in March but I am worried that the Chase health bill of $20,000 will be seen as abuse and objected to. Does anybody have any thoughts on this?

    Since this was a health issue I don't see any logic in anyone considering it fraud - but then you never know. Didn't you have any dental insurance??

        Can you wait until March so its over 6 months since you had the work done?

          I plan on waiting until March. The only issue is that I am starting to get served. Amex just served me about an hour ago and I was served with a foreclosure about 2 weeks ago (night before Thanksgiving).

          Another concern is that they will say that I was insolvent when I took the money and so I knew I could not pay it back.

            Ouch - $20,000 worth of dental work makes me hurt.

            341 - 11/26 went smooth NO ASSET
            Took 115 days after 341 - But Finally DISCHARGED 3/25/09

              Keep in mind that you'll be shedding 150K so 20K still owed isn't that much. Just one way to look at it.

                No, I think as long as it was necessary you're fine. If it was cosmetic, yes, it is a problem. We had a lengthy discussion about the origin of my huge medical bills with the attorney for the UST at our 341 hearing. It was embarrassing, but I remember thinking I was glad the bills were for medically necessary surgeries and not for breast implants!
