    paid in full but still not filed?

    so i paid my attorney in full 1000$ in october, took my pre-bk class BUT im still not filed. its been 2 mos and im not filed what is going on?
    so i stop by there office to give them so new mail.

    i owe student loans, 4000 but now it's 6000 collection fees i guess they sent me a letter about repaying them under a iincome contigent plan,
    is this plan good i google some info on it. bc they said they would garnish my wages i think it was 15% or 20% they said i would get garnish. so i took the letter to my guy, they said well if it a good interest rate you should think about it. and then the secretary told me when you get a notice about you wages being garnish call us and we will file you, what is going on?

    i still get calls everyday about my students loans, i know they wont get disacharge so i may do this income cont plan.

    any thoughts?

    Does your attorney realize that you have paid in full for the BK?
    Are the student loans the only reason you are filing - or are there other debts?
    Did you discuss a strategy with the attorney regarding your filing? (Like, don't file until your wages are ganished???)

    Did you specifically discuss alternative repayment plans with the attorney for the student loans?

    It sounds like, just based on your posting, that either the attorney is not aware that you are paid in full and have expected to have the filing now - or the attorney's office is so busy they have put you off for a while. The attorney may not be aware of this lapse since usually the staff fills in the paperwork for the attorney to review and occasionally one might 'slip through the cracks'.

    I would contact the attorney right away and ask - what is your plan now that I am paid in full? Tell him you expected to be filed by x date and want to know if there is a reason he feels it is better for you to wait (if that is what he is doing). Could be he is waiting on your filing fees, which are separate from the attorney's fees. Ask him.

      Student loans aren't going to get discharged in the BK. You need to just call your attorney and ask them when they are filing. Like StartingOver said, you may have just fallen through the cracks.
