Why wait after cash advance?

Why do you have to wait 90 days after a cash advance? Wouldn't a cash advance be a symptom of someone who has hit hard times?

My lawyer said cash advances don't count as income (we had some 6 months back- trying to pay things). Why else?

Presumption of fraud by statute. You do not want to have to repay those cash advances if the creditor objects.
