When my husband and I filed (Chapter 7) we surrendered his Nissan truck that we were horribly upside down on. About 3 weeks ago we go a letter saying it had been sold. A few days ago, we got another letter regarding the service agreement we had on it. The letter says they got a request to cancel the service agreement, and that we are due a pro-rated refund. It goes on to say that they sent the check to the lien holder for processing and we will be getting a credit to our account in 3-4 weeks.
As you can probably guess, I want to know whether or not we will get this refund or will Nissan keep it? My husband says we shouldn't get our hopes up, and I tend to agree with him because we technically broke the agreement. On the other hand, we were discharged from that debt and no longer legally owe Nissan anything, so my brain says to me, "Money on the way!!!" Anyone know or have any thoughts as to what will happen?
Oh, and if we do get the refund, will we need to inform the trustee as it is a good chunk of money? We were discharged Nov. 14, Chpt 7, no asset, still not closed.
