    Picky question...

    Can I pick and choose what debts I want to include in the BK or are all of them automatically listed?

    Example: I have quite a few very small amounts that are with collection agencies for things like medical co-pays, etc. After my BK I could just pay them off. My main concern with my BK is the huge amount of unsecured debt and after I am out from under that, I will be able to pay the small stuff with no problem.

      Yes I agree, you must list everything, and you will be glad you did, trust me. I too wanted to save one credit card, just in case, thank goodness I was not allowed to.

        My question is why do you want to go through a bankruptcy and leave out any bill to just pay later?

        When I filed I even included one doctors office that I owed a measly little 15.00 to. I would of listed someone I owed 1.00 to. You might as well discharge it all. But no, you cant pick and choose.

          Your Trustee is going to ask you if ALL creditors are listed. and everything will be dischrged even if you don't. chapter 7 no asset wipes everything

            Because I don't want to file BK. Unfortunately, I have to. I did mess up and I now pay over $700 in unsecured debt payments every month. I have at times had to borrow money from my elderly mother just to pay my real estate taxes or make my mortgage payment because I am so BROKE. Filing BK will wipe out all of my debt except for the mortgage. With those big debt payments gone, I thought I would then be able to pay those little piddly debts that are hanging around. But if I have to include them, I will. It was just a thought

              that includes your mother. you can pay her after the BK but you would have to include her. the trustee would see the money coming from her.

                Hey we understand. The small bills aren't the issue, it's the biggie. But when you look at it all, a "Fresh Start" is meant to be just that. Clean, fresh and new (Well, sounds better then beaten, abused and defiled) and then you can take the time to sit and say "Do I REALLY need this?" when considering a purchase.

                Life will be so much better without the little nagging thought of "Hmmm..Have to pay so and so...and then so and so..then..Oh they'll have to wait...Oppps LATE FEES!!"

                In my first BK, I was also wanting to pay some of the little ones and my lawyer said "Just list them all, as that's required. If you want to pay them, then how about totalling up the amount, then donate the money to a "Worthy Cause" that helps others?"

                Hmmm..I liked that and did...That was after I'd gotten a new job and had some cash to spend again.

                  Legally you have to list all debts public and private.

                  After discharge you of course are free to pay any discharged debt if you so desire.
                  May 31st, 2007: Petition Filed by my lawyer
                  July 2nd, 2007: 341 Meeting Held
                  September 4th, 2007: Discharged and Closed.

                    Yes, accept your complete discharge from all of your eligible debt. If you feel morally obligated to pay a debt after BK you can volunteer to pay that debt AFTER your discharge. For example, anything you owe your mother.

                    To pay a $15 medical bill - forget it.

                      I hear ya. I hate being in this position, in fact before I considered BK I contacted my mortgage co. and applied for a consolidation loan. It was approved and we were two days from signing the papers when I changed my mind. It would have doubled my payment and run for 30 years. I would have been almost 90 when I finally paid it off. YIKES!!

                      So I started looking at other options and found this site. You all have saved me. I never thought that bk was a real option for me. And not only did I get the info I needed.....it is sooooo helpful to read the stories of others who have gone through this and ended up really OK.

                      Thank you all, I feel like I am going to get my life back. It was that bad and I was so desperate. (I'm tearing up here, I need a kleenex.)

                        I am glad you found us before you liquidated a 401k or other retirement instrument that is exempt property in a BK.

                          We have no 401 K or other retirement savings. Nothing. We will have my SS and my hubby's SS plus he will get a really nice pension so we will be OK.

                          But today, there is no other money that is available. And there are so many folks who are in the same boat as we are. I think the cc companies try to get people into messes like this. In fact, Beneficial continues to send me those pre-approved checks in the mail....just deposit in your bank and 'poof' you have a loan. And I am already into them for 10K. I am SO ready to quit paying them.
