    Any recommendations for a Virginia BK Attorney?

    Greetings ~

    I met with an Attorney during December that said I didn't qualify for CH7 because I'm above the median income for a 1 person household ($800 per month over and with my OT during the past 6 months it's higher) I've read that is not always the case. What basis would allow me to file CH7 in lieu of CH13 with a higher income?

    Also, I'm waiting as long as I can to file because I earned a lot of overtime on a project during the past 6 months and I'm trying to get to a point my gross earnings are more realistic. I currently am not authorized any more OT as I transferred to a new department.

    I fall in the Western District of Virginia and would like to consult with an Attorney that is really good - anyone have a referral? I paid $250 for a consulation and was with him for 2 hours. I've learned more on this site than when I was in his office...such as considering closing bank accounts so my money doesn't disappear from creditors and receive paper payroll checks and not direct deposit. There are certain strategies I need to consider.

    Another quick question...I am on title to our home (we are not married) I don't want the house, we are separating. My BF is filing CH7 and is considering giving up the home as well - how long can we live here and not make the mortgage payment - when the BK is discharged or when we file? I hope someone will rent to me and I can afford rent after the BK. I fear CH13 will not allow me to eat. I'm really afraid and I'm looking forward to a full nights rest.

    When we were searching for a BK attorney we avoided the ones who wanted a consultation fee. I am not saying the bk attorney doesn't have the right to charge for their service, but there's a reason why your seeking the advise of a bk attorney and I refused to waste time and money.

    Have you tried "googling" a bk attorny?

      On this site, there is a rule that we must not give referrals. It causes this place to a possible litigation for those that take advice.

      That being said, Give your BF a quit claim Deed to the house and let him take it down. I'm sorry for your separation but this is business only.

      If you lawyer charges that amount of money, I hope he is good. Negotiate with him what the whole bill will be and ask him to credit you. Seems high to me but I do not know your area and it's cost. 'Hub

        Once you actually find a few attorneys, you can actually search if they have any malpractice claims against them.
