I just wanted to thank everyone on this site.(I know I don't post alot but I try to read all the posts) It has been my support system some much useful information. We are a few hundred dollars from filing and I finally started to answer the phone today the first call I took I was nervous but it went fine. Its nice not hearing the phone ring all day. I do have a question since I have told them I'm filing I shouldn't here from them right?

Once we told the caller(s) that we were filng, and gave them the attorney's contact info, that pretty much took care of all the phone calls. We initially retained our attorney in Aug. 2006, paid the rest of her fee in Jan. 2007, and filed Dec. 28, 2007.
Now when you do file, the Automatic Stay kicks in and any creditor contacting you after that (allow reasonable time for the notices to travel thru the mail) then that creditor is in violation of the law and can be hauled into court.

So to get this straight, we have credit cards and a house and a truck we are filling on. We have 700 left to pay our lawyer can we space that out a bit.(I would like to wait a little while to file the house we are in now has a contract saying we will rent until our house we plan on filing on sells. I really don't want to get booted out in the winter time we have been looking out for rentals but no luck.) As long as we say were in the process of filling is that good enough or will the creditors start getting impatiant. It took our lawyer 2 extra months to get our papers thru. In that time, after the initial call where we told them we were filing, the only calls I got from my creditors were some that were concerned because it took so long. They were afraid they'd been missed. It gave the the kick I needed to get my attorney to get on the ball.
Yes, it's SOOO nice to not get the calls. We've been on Chpt 13 since July and I have to say, I'm willing to go pick our mail up out of the box now...I look forward to the mailman again!!!!!
