    How do you know when the UST is done????????

    Hi everyone, how do you know when the UST trsutee is done with his audit? Many of you know that the last day of objections was yesterday for me and the UST extended my discharge for another 90 days. (YUCK)! Will my attorney be notified or will I just see it on pacer as discharged, (I HOPE) for dismissed (I TURELY HOPE NOT)? Also for the people that have been audited and extended by the UST, do they always take the 90 days?

    Also, if my hubby gets a raise or a bonus before we discharge or a tax return will we lose them?

    If you have a good attorney, maybe they'll be in touch with the UST and give you a heads up as to what they plan to file. Otherwise, you may not hear anything until you see the UST statement on PACER within those 90 days (who knows when?). I would not expect to be discharged right away after that, as the clerk will have to discharge you manually. Maybe someone who's had the UST file an extension can comment on that part of your question.

      I don't have anything to add, except that I am thinking of you guys & hoping all goes well. I think all the UST offices must have got some coal for Xmas and now they are being meaner than ever, lol!

        Your lawyer will get a letter from the UST with the findings.

          Yeah it seems like I will have to wait for a letter from the attorney or find out thru Pacer.

          This is consuming me every frigin day. I cannot stop thinking about it. I am probably aging myself with this, so by the time 90 days rolls around I will feel like 90 years old. LOL

          welovedis - You are probably right, but I will tell you this. If i could give them a gift i would of gave them a lump of shit.... LOL Only kidding.... That jsut made me feel alittle bit better.LOL

            Dh & I just talked and we have decided that we are going to try to fight this if they do, indeed, file presumed abuse. We have gone over our records and can show receipts and documentation to support a much higher amt for medical than we were claiming as well as clothing which will send our Schedule J into the negative. We can honestly back up each & every figure on there so we'll see how it goes.

            And I agree, one day I feel ok, the next day I am reeling from the remarks the UST says and feel like I've been hit by a truck. Just know that we are all here pulling for you, no matter what!

              I'm pulling for you to!!! You go and fight this. I am sick of them being bullies.... If you have all the receipts and documents to back yourself then by all means fight for your rights. (Now i sound like a beastie boys song) LOL. I am dating myself with that remark. Are they even still around.

                Jessiegirl: you know how much trouble Mrs. C and I have had. Ours too was extended to 90 days plus. Actually six months. We did not get audited but probably should have as we were dumb as bricks. We were asset, preferential payment, insider payment, and other real screw ups. Didn't know a damn thing to do. Found bkforum during this process and found how truly ignorant we were. If you did not do as much as we did to screw up, you won't have a problem. We even got a 2004 investigation. We made it though. Now to pay the rest of my preferential payments to the Trustee before close. I paid debt twice. 'Hub
                If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

                  Hey Hub - I know you and the Mrs went thru hell. It sucks when you have no money and then they make you pay the debt twice.

                    I was audited, my case was extended due to the audit and I don't think I found out that it was done until I logged onto PACER one day and saw it. You can see from my timeline how long it took.

                    Good luck! I know it's nerve wracking.
                    11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!
