    Worried after reading welovedis situation....

    I am now worried how to handle my situation after reading how the BKT has been treating welovedis. I did not know they got that tough. We lived above our means or we would not be where we are today. It has taken about 8 years to accumulate about 80,000 in unsecured CC debt. We have no secured debt except our home that is exempt. Two old cars paid for. We are 4 months past any purchase over 550 and 2 months past a vacation we took using FF miles and about 1,000 spent on the trip. We have always taken family vacations a few times a year and eat out from time to time usually under $50. I buy beer frequently and wife smokes. Other that that we have no luxery spending. How drastic of a cut back and for how long should we do it? I believe we qualify for chaper 7 and our income is below the mean with 5 in our family. We just now have had to start useing credit cards to keep checking account above zero and paying 1600/month on just min payment to CC. Mortgage is 1100/mo and take home pay is about 3,000 monthly and wife gets 650 CS from her ex. I could probably hold off for about a year but that will require me to continue to use credit cards to stay above zero in checking to make all minimum payments. Please give any advice!

    If bk is on the horizon, stop paying all debt you wish to discharge and learn to live on a cash basis.
    Just wait a few months before you file. I'm of the opinion that the poster you mentioned story is the exception and not the rule.

      I am worried too after reading the post. We had all of our credit cards paid off in June 2008 and then charged up 32k(paying bills with the credit cards) from June to November! Yikes hope they don't give us trouble!!

        Kansas, and everyone else who is worried after reading my situation:

        Please realize that my case seems to be the exception, not the rule. It appears that in our district the crackdown is on and whether or not we try to fight it is our decision.

        Others here have posted about being in similar situations to ours, yet had way more debt that was discharged, and their cases went off without a hitch.

        I'm not saying that there is a sure-fire guarantee you'll be fine, but I think out case in not being handled normally and I'm not certain why.

        04/27/09 Confirmation hearing for CH 13
        $199/mth for 60 months + $9K 2008 income tax refund

          Keep in mind also that the UST randomly picks cases to audit from time to time. Welovedis seems to have been the unlucky pickee for their district.
