    when they decide chpt 7 or 13..

    do they look at all your bills, even the ones you are discharging? I am worried that we will have disposable income since we are discharging all our cc debt(500 min payments) our one vehicle (560 a month) and our mortgage (720 a month)

    So after all that our gross is 4000(2800 take home) a month and "just surviving" bills will only be about 2000 a month.If I go by SchJ Post bankruptcy bills I have a 3100 total but that is using IRS standards.

    We are under income for the means.

    I'm not 100% sure, but I think if you're under the median income for the means test you qualify for Chapter 7. If you're over the median income is when they do the additional calculations to see if you're 7 or 13.

      It is VERY helpful in understanding how they calculate whether you qualify for Chpt 7 or Chpt 13. It also shows you what they look for and the amount they'll allow for expenditures!!!!
