    CC Legal Action

    I can't file for about 4-5 months. It is going to take that long to pay for the house appraisal and my lawyer. If one of my unsecured creditors would file suit against me during that time, would filing the BK stop the lawsuit? And who would pay the costs of filing? How would that work?

    I just want to know what may happen. I quit paying the unsecureds this month and I am trying to remain calm. Knowing what to expect will help.

    I stopped paying all cc's last July, filed on the 16th of this month. The next day after we filed we got a summons from AmEx (they gave it to my 14 y/o boy while we weren't home!) we called the atty on the summons and gave him our case # and it will be dismissed. It depends on who the creditors are I think (some are more aggressive than others). I know some folks went alot longer without paying then I did before filing. It probably also depends on how much you owe. We owe ALOT, but hopefully not for much longer!

      A bk filing will stop the lawsuit and any fees the creditor spent in taking you to court will be their responsibility. All debts to that creditor will be discharged.

        4-5 months without paying? Seems like even the most aggressive creditors aren't going to sue in that short time frame! Breathe easy and just keep a close eye on things - read everything that comes in, you'll get plenty of warning if they do sue.
