    Tax Refunds/ EITC

    I got a letter from the trustee saying I have to send in copies of my taxes. I understand that they may want to take all or a portion of my refund. The question I have is this. I didn't make much money in 2008, I believe I will get a refund but it will be mostly due to the Earned Income Tax Credit. I live in Minnesota, is this exempt from them taking any of it? I need the refund to get my vehicle fixed and to pay my mortgage for a month or 2. I tried calling my attorney's office and spoke with the person who answered the phone but I don't think she understood what I was asking. I asked to speak with one of the paralegals but she wouldn't let me. Any insight? i will try calling my attorney office again too.

    If it is in your plan documents that your trustee can take your refund, then your trustee can and WILL take your refund. Some trustees take all of it, some take the first $1000 or anything over $1000.

    I would look over your plan for answers.

    I am at 100% payback so they won't be taking mine, though, my trustee doesn't generally take refunds unless you are behind.

      Thank you for your response, I did talk to a paralegal in my lawyers office. she said the best thing for me to do is to send in copies of my taxes and also send a letter with them asking to keep my refund and to explain what I need the money for. I will give that a try and see how it goes. I'm not behind in my payments so hopefully it will work.

        it should have been noted in your hearings. In my 341 others were forced to give half throughout the plan. I was not required.
