    get a new attorney...or ???

    I hate dealing with attorneys!

    We filed chapter 13 back in October. November & December were fine, but January and February, my husbands pay has been 1/4 - 1/2 of what we need. Needless to say, we have not been able to pay our mortgage.
    I called my attorney last week and they had me fax over new pay stubs and said maybe we need to convert to a 7. My attorney's assistant is the only one I ever manage to speak with and she was busy and said she would call me. guess what....I havent heard from her. I have called twice, once on Friday and was told she would have to get back to me next week, so I called again today and she was 'unavailable' and will call me back.
    I need to know what to do! I need to know what happens next! I need to know how long I have in this house before we have to get out. If we're going to convert to a 7, do I still pay my Trustee at the end of this month? or can I use that money to pay the new fees to file for a 7? This is totally stressing me out!
    They werent very good about returning calls very fast while we were in the midst of filing for the 13 either.


    s this normal? I think it is HORRIBLE customer service.

    Should we find a new attorney to help us file for a 7? Is that possible? part of our attorney fees for the 13 were included in the bk, what happens if we convert?

    I think you need to relax first of all and understand that BK attorney's are very busy right now. Not saying that you don't deserve an answer but I bet they are swamped. And it won't get any better.

    First, you have already filed. So your mortgage company has to go to the court to lift the stay and all of that takes time. Plus you are JUST behind on your mortgage.

    You have time and do not need to rush to a judgment on what to do or to move right away etc.

    I would relax and wait until next week to give your attorney another call. Now if they don't answer you for weeks and weeks, well then, go to their office to get your answers.

    But this is all just beginning so give them a sec to get back to you and stay current on the trustee payment. Don't compound your problem
