EduCap and Loan to Learn

Are Loan to Learn (a subsidiary company of EduCap) student loans dischargable through a Ch 7 bk?
I am wondering because I was sent an e-mail by them discussing settlement offers, most of which were outrageous, but at the end it stated that if I have filed for bk then to disregard the e-mail.
So in turn that prompted me to ask a bk lawyer about discharging these loans, in which I was told that if they are not a federally insured lender that I can file a Ch7 and have them discharged. Is this true?
I have done some research online and haven't found anything that states that Loan to Learn is federally insured. But I have found court docs that have found in favor of Loan to Learn and EduCap stating that they are student loans and are not dischargable.
Does anyone know anything about options dealing with these types of loans?
Also if they are not eligible for a Ch7, then is a Ch13 a better answer to them?
