I filed for Chapter 13 on September 7, 2005, and my first post-petition mortgage payment was due on September 19, 2005. It is paid through an escrow company/loan servicer. When I made the payment, they accepted it, wrote me out a receipt for the payment with the time and date I made the payment. I have been waiting for the payment to clear my bank account and it hasn't. I have not received anything from them stating that they cannot accept my payment and I haven't received the check back from them in the mail.
Since I have a receipt, has the payment been made? or have they not credited my account and are holding my payment so that the account can be delinquent post-petition.
Am I ok or should I be looking for a motion for relief from stay being filed against me? Suggestions? Ideas? This has me so worried that my stomach is burning and I want to cry. I worked very hard to get that payment in and now to have this happen. Am I making mountains out of mole hills?
Aren't they required under Chapter 13 of the United States Bankruptcy Code to accept the payments and credit them post-petition? So have I made my payment or am I delinquent? Please advise.
