    private student loans and credit reports

    3 questions:

    1. Are private student loans dischargable? I have 2 loans through MOHELA that were included in my bankruptcy. I do not believe I used them as a lender towards a student loan through fed financial aid. What will happen with those?

    2. It appears as if one or two accounts I included in my bankruptcy have all but disappeared from my credit reports. One being my Ashley furniture accout through citibank. Why wouldn't these be showing up? I checked experian and equifax, and I just do not see the account on there anymore since my bankruptcy was filed. Is this a common occurance or something I should be concerned about?

    3. BOA is still showing as "charge off" instead of "included in bankruptcy" on my credit report. The collections agency they sold the account to is showing on my report, with no comments. Is this something I should only write in to dispute after my discharge next month?

    Unless you file an AP, go before the judge and have them
    declared discharged they will survive your bankruptcy
    unaffected.

        The private student loans are NOT discharged. Even though listed on your schedules, they will remain after the bankruptcy. The only way to get them discharged is to file an adversary proceeding and claim hardship. It is nearly impossible to do, unless you are completely disabled and unable to work for the rest of your life.

              1. The student loans are not discharged, sorry

              2. Count your blessings. No, it is not common for accounts to just disappear. I am willing to bet they will show up at some point in future. Just make sure they say included in BK.

              3. This is a tricky area of credit reporting. If the charge off happened before BK, they can still list it, but they also need to include a comment about BK. I would dispute it to try to have it reported as Included in BK. As for the collection account dispute it as well and try to get it removed from your credit report (but that may take a few go arounds, and eventually may not work )
