    received check from medical insurance

    Not sure where to ask this but we are planning on filing really soon hopefully a 7, I had a medical procedure done and it was at a surgery center that wasnt considered a provider on my plan so my health insurance issued a check to me in my name. What would happen if I cashed this check and used it to buy a cheap used car? I know the medical provider will send me a bill but if I am filing BK can I include them?

    Yep, since the debt was created prior to filing they can be included in the bk.

      Um, if the insurance company gave you the money to give to the provider, my guess would be that's what you should do... definitely ask your attorney before you spend it. Would that be insurance fraud if they paid a claim but the money didn't get to the intended recipient? I'm not sure...

        Assuming she didn't file a fraudulent claim, this isn't insurance fraud.
