Florida Wild card?

I found a site (bankrutpcyinformation.com) that listed 'see homestead' under wild card, but nothing in the homestead exemtion said anything about a WC.Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

HI- I live in Fl also but we have already received our Joint Chapter 7 discharge.
You and I are in the same kind of boat here but I think ours may have a bigger hole in it cause it sure seems to be sinking pretty fast (LOL) We have titles to two 1999 cars.
Days after making our final payment to our atty and he files our papers ... boom! He closes his office and no longer is doing bk and doesn't seem at all interested in finishing this up for us.
We knew we were going to have assets (We chose to be honest and did not hide things) but when we rec'd our discharge, pacer showed it as "No Assets" Long story short...now they have converted it back to an asset case and gave our creditors 90 days to file claims. I know that I need to replace my dead-beat atty but that is not going to be easy to find another atty willing to jump in at this stage of the game to rep us. The trustee never said anything to us at our 341 about our assets except if we would like to keep them (DUH?) Sure, We'd love to keep them.
I have written a few post here but not much help. I get the impression that not too many people here like us with assets.
Anyway, at this point I do not know what the next step is but maybe being I am ahead of you in this process...you may like for me to keep you informed.

Yes, please let me know. My attorney is kind of weird...kept wanting me to file a 13 instead of a 7...my only asset is my 2000 4Runner which I own free and clear and if they take it, I guess I'll be biking to work. What did your attorney say about your two vehicles? Have you tried calling any lawyers? I know I just hate picking up the phone to call mine, he talks to my mother more than me but she's 80 and has no computer access so I try to do a lot of reading on this site to understand what I'm about to face. My attorney tried to scare me about how it is if you get a nasty trustee...after what I've been through in my life, a bankruptcy person is not going to frighten me...lol! I've got nothing to lose but a car...and it is replaceable...plus gas prices most likely on the rise...let 'em have the guzzler...I'm sure someone else would love to put $45 per week into it!Originally posted by barbieinflaHI- I live in Fl also but we have already received our Joint Chapter 7 discharge.

my atty, knowing that we had an asset case (and him also knowing he was closing his office, the snake, all he said is that we would have a chance of buying them back and he would handle that for us...but no word from him since. I will be trying to contact him because now is the time that I need him most. I will keep you informed and if you hear anything I would appreciate the same.

Have you had your l41 meeting yet??? Did the attorney show???
You didn't say.......
If he does not show, explain why to Trustee....... who will more than likely put your case on hold till another attorney is found.
Also file a greivance/complaint with the state board where he is liscensed....
Remember, attorneys are "not above the law", either...........
He can be sued for malpractice and loose his liscense completely..

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

But I was of the opinon, why do I want to buy back a car I already paid off? I think my lawyer said it would be around $3K to do it...well, if I'm going ch. 7, where is the money coming from to pay on a car I already own? I'm going more broke every day...and now I'm gonna be charged probably $10-$20 on a checking/savings account that I can't even put any money into...well, at least I can hopefully get rid of my cc debt ($50K).Filed Oct 2005discharged February 2007,Shapeless in the fire's glow, tell me if you think you know,
