Currently, my husband and I live in CA and we are moving to Missouri. I have debt out the wazoo. Almost $200,00 of secured and unsecured debt in ONLY my name. He, on the other hand, only has about $15,000 in unsecured debt. I would like to file chapter 7 without my husband. When we consulted w/ a BK atty here in CA she told us that even if I filed by myself that would automatically make my husband responsible for my mountain of debt. We went away discouraged. In a couple months we are going to be moving to Missouri which is not a community property state. Once we get there, can I file chapter 7 without my husband? OR, will we be grandfathered into CA law since that's the state we were in when I accumulated most of the debt?
