    Auto loan question

    I have 2 car loans with a Credit Union. We have not payed on them since December's payments. (made Dec payments on Jan-17) In March we will be 3 months behind. Our 341 was in late December, last day for objections is 3/30. We did not refirm. We planned on keeping both cars, but are now just going to turn them in. My question is how long do we have before they just come take the cars. Also could this mess up our Chap-7 before it can discharge. I don't want them to put a judgement in before we close. thanks

    It depends on your lender I think, we filed in Oct have not made a payment since September and we were discharged middle of last month. I got an email from my attorney just this morning letting me know that my lender has asked the court permission to get the car.

      You might want to have the attorney file a notice changing your intention from reaffirm to surrender on your vehicles prior to your discharge. It only takes a few minutes. Then make sure you hold out on contacting the lender to pick up the vehicle as long as possible. I called the day after discharge to make arrangements for the surrender and they picked up the car 4 days later.

        Thanks, I just don't want to screw anything up. I just want to close then I will call them to make arrangements. I just didn't want to get pushed to a Ch-13 because I turned them in.

          My attorney said once the Trustee files the No Assets, No Distribution report and the Abandonment of Assets then you are good to go in a Ch 7. Naturally, you do what is good for you.
