    Discharge question

    Ok so Pacer is back up and now I have 92 days as status - this seems to be longer than most cased on this board. Do you think it might be there are so many cases that the court is backed up or do some case just take longer?
    Thanks for any reasurance you can give me.

    Some filers have had success by calling their case manager and seeing what is up, the CM then goes in and closes the case and issues a discharge.

    Did you have any assets that were/need to be distributed?

    Has the Trustee requested your tax return for 2008?

    Sometimes these issues may cause a case to stay open.

    If you had a fairly smooth BK, it may be an oversight or a very busy court needing to get caught up.

      Hi thanks for the reply my case was a no asset chpt 7 and there were some old taxes involved, but other than that I handed over all requested documents and haven't heard from my attorney. So I guess I will wait and see. I live in the Bay area N CAL and seems to be alot of foreclosures and layoffs etc... so maybe that has something to do with it taking longer. again thanks!

        Maybe you could call your attorney and ask him what is up?

        Perhaps he can call the court for you and see if they can speed things up a bit or force the discharge. It may have slipped through the cracks?

        I guess no news is good news in the BK world though.

          hI dingdong that is true in my case the longer the better I am also working out an OIC for the feds and the longer this process takes the better I can be and get prepared for this part of my downturn. Thanks I think I will just go with the no news is good news.
