    'Quick Deed' by ex, what can I do?

    So my now ex quick deeded the house to me, I filed Ch. 7 and included my mortgage. I'm going to be going over my financials before I call country wide to see if there is anyway i can keep, and afford, my house. Does this 'quick deed' mean anything? The ex is still on the loan but wants nothing to do with the house and he is close to bankruptcy himself being self employed, his business really has taken a hit with this economy.
    Anyone have any advice? Thanks!

      You are actually fortunate. A quit claim deed means you own all the house. Be thankful. The half of mortgage if you bk, will become his problem in it’s entirety. If he bk’s I’m not sure how that works as the house is a chattel mortgage. In his ignorance of the law, (as if I’m not) he thinks he has dumped the problem on you. Not so. There is a Deed, and then there is a Mortgage. The Mortgage holds a lien on the Deed. He cannot escape. Either you, or he will have to pay the mortgage or the house WILL be foreclosed on. I think he believed he just dumped this on you. Only my opinion. ‘Hub

        So should I not even try to keep 'my' home? I understand what you're saying though and yes I think he thought he wouldn't be responsible for the loan anymore. Oh well, going to see what CW says....Thanks for the reply, appreciate it!
