    Question about lawyer and auto

    Morning fellow gurus.

    I was wondering, do you guys think it's a good idea or bad to use a lawyer who is also a trustee?

    The positive is that they obviously know the paperwork well and are highly unlikely to make a mistake or cause a delay. They have quite a bit of knowledge on BK but they are not to keen on discussing any pre-bank planning. Which I think is because it may be a conflict of interest, being a trustee. In terms of exemptions and stuff like that, they are quite knowledgeable and know what works and what pushes the limits.

    Also, according to the lawyer a ride-through is no longer an option and we must either hand the car over or reaffirm it. So I don't know how to say well I would like to try my luck and continue paying for the vehicle but no reaffirm.

    It is an excellent idea regarding using a Lawyer/Trustee. He has seen it all from both sides and knows every trick and loophole.

    Tell he simply that you wish to keep the car till they pick it up and continue to pay. They don’t want your car. Dealers are chocking on their cars, new and used.

    He may see you cannot afford the car. Talk to him and ask him. Remember he works for you. He is your employee at this time. You might get a better used car and lesson your payments. ‘Hub

      Thanks for the info.

      He was nice but to the point. He did not sugarcoat anything and even said that the creditors are ruthless. That they can come after you if they find any discrepancies.

      Any pointers I get from this guy I will post them here. Especially for the pro se to think about.
