    Just signed petition and have a question about a new law?

    I went today and signed the petition to file Now we are a little over the median, but I am now unemployed so theoretically we could wait a couple of months and be clear. Now, my question is, the paralegal said something about some law that just went into effect Jan 1st regarding military members and income... Something to the effect that the median income thing didn't apply if someone was in the military active or reserve?? Can someone explain to me in English what this is?

    This link describes the changes very well. Essentially this is a temporary measure effective 12/19/2008. The qualifing party is exempted from the means test during the time of active duty. It describes who qualifies and when the active duty is terminated, then the debtor has to take the means test.

      very strange...my dh is a reservist and not activated at the moment. He was activated in 06. This doesn't seem to apply to us. I told her 06 and she checked the box and said "sounds like you qualify" This office is like an assembly line. They seem to know what they're doing and have their stuff organized. Should I be concerned? We were over the median, but I am sure our expenses put us in the negative.... I guess I will see!

        You were working with the paralegal and not the attorney, right? I would bring it up with the attorney, delicately - because most of the time the paralegals run the office!
