When is it safe to w/d from retirement acct?

I have a small pension...very small... but I would like to w/d to pay for some classes I am taking this summer. We signed the petition and are waiting for the lawyer to submit. Is it safe to start the withdrawal process after the 341 but before discharge and possibly have the money before discharge? Or should we wait until its all done?

I had to take some out of my 401 K after the 341. But this is because my hubbies business is tanked due to the economy and I have been unemployed the last 2 months. Had no income at all and no savings after BK. Had to do it in order to not live in the street and to pay child support.

Technically, you can do the withdraw any time after the case is FILED. However, practically, it is usually better to wait until after the 341 meeting.

I wondered this also but ours is from a IRA. We are moving and need to take money our BEFORE the 341 meeting. We are going to buy a trailer so I am hoping that the trustee won't take it.
