    General Bankruptcy Questions

    1. Husband is considering filing joint with me, but he has a cc and a car loan that he is listed on. In both cases his parents are the main account holder. Will he need to include these, and how will it affect them if at all?

    2. Should you include creditors that do not normally show up on your credit report such as Columbia House, etc.

    3. I have an 8k car loan which appears on my credit as a paid charge off. I have fought for years with the OC to get it removed totally but all they will do it update to paid. Should this be included on the BK so that it is removed, or not?

    4. What happens to your credit report when all is said and done? Are the old debts removed totally or just zero'd out?

    Regarding the paid CO, you would not include that in the BK as you've already paid it. BK does not make the accounts disappear from your credit report, it just updates them to show you no longer owe a balance.

    Is your husband simply an authorized user on his parents accounts, or is he a joint account holder? If he is AU, no issue though they may want to remove him for a while. If he is an account holder, he'll need to include those debts. For the car loan, he can reaffirm it.

    You can include any creditor, so any that you owe money to. (Even if they do not show on the credit report.)
