We received our discharge August 8, 2005 for our BK:yahoo: . Our mortgage company filed a stay of relief with the court case heard Sept 22, 2005. We did not attend, as we had indicated in our BK case that we will turn the house back to the mortgage company. Our situation is this - our house was rented for the last five years as we had to relocate for work (could not sell the house). The rents we received were $150 less than the monthly mortgage payments. I just received a call from the mortgage company stating that they were going to foreclose, and what our intentions were regarding our house. I told them that we had agreed to turn the house back in our original BK filing. I then explained that there are tenants in the house right now. I asked about the foreclosure process, and they stated that it would take up to 45 days to process. What can we expect during the foreclosure? We are in Colorado, if this makes a difference.
