My husband & I are in the process of seperating & I might have to fill bankruptcy within the next year if my medical condition does not improve. My question is if we are seperated but not divorced will his income be included on the new means test? I am on disability for my medical condition & my check is 1800.00 so I think I would qualify under the new means test to file chapter 7 but I didn't know if they would count his income if we are not living toghether.

I *think* it would be household income, so if you & he lived in different household's, his income would not be considered. But, you would have to indicate any alimony/child support being received.Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's.
