    im gonna come clean!

    no, not really...
    i got a letter from citibank today that said they want to help... i looked closer and it is a collection agency...

    it said they would accept any resonable offer of the 10250 that i owe...
    however, it said that if i dont make them an offer withing 5 days, i am admitting i am a fault and agree to any terms they say...

    well, im not going to contact them, so i guess that im admitting that ive been a bad boy!

    This does not sound right. It is one of those "have you stopped beating your wife" type questions where there is no right answer.

    Whether you owe the $$ or not, I would at least DV the CA and make them prove they have the right to collect etc. I know a DV is not the end all answer, but it at least registers your objection to the amount and to the CA so they can not impose "any terms they say" on you or come up with some balance that is outrageous. It only takes a few minutes to send a DV letter.

      Or it sounds like the response I got from a CA when I told them I could not afford to pay what they want, but would be sending in a payment (less than what they wanted). They documented it as a refusal to pay...ok!

        Dont waste your time with them, it wouldnt hold up in court.

          If it is a CA they are 'bound" (haha LOL, whatta joke) by FDCPA. You can, if you want, send a DV within 30 days. That "within 5 days" malarkey is just that, malarkey.

          Somewhere on the letter, perhaps the back, should be the standard "you have 30 days in which to dispute this debt, otherwise it will be assumed to be valid, yadayadayada"

          I would spend the $5 and send them a DV letter, certified mail return receipt about 7 days before the 30 days is up. I would go by the postmark on the envelop of the letter you recieved and include a copy of the envelope to prove when you received the letter. I noticed that the letters I have received from CA are dated about 10 days before I actually receive them, but of course the postmark is only 1 or 2 days prior to delivery date You probably won't hear from them again, or at least for awhile.
