SO, I have a US Bank credit card that is about 90 days past due. They call my phone about 3-5 times per day. They called yesterday, and I decided to call them back. I owe about $1300 (princilpe/fees/late, etc.) The woman immediately goes into the script of when can I pay, they have a special program, etc. I tell them I don't have a checking account available. They finally agree that I could go down to the local branch and make a payment, but then I would not qualify for the reduced 2% contract. I said, "Too bad." I'd agree to a $20/month payment. They finally stated that I could go down to the local branch and make some kind of a payment (right, not without seeing somethign in writing.) Fifteen minutes later another party calls me back. I tell them I am currently working on an agreement with US Bank and am considering working with them as to how we can resolve this issue. The women (credit card services) was obviously a contracted collection agency kept up the spiel of when and how much they needed a payment for. I informed them that I had just spoken with US Bank and will work directly with them. I also asked them for their address (card services.) THis is sneaky, but these folks are third-party debt collectors. I'll send them a DV and C&D on Monday.
For those of you receiving calls from "credit card services," I think it is safe to say that these folks are 3rd party collectors and you should ask their name and address and send a DV and/or C&D. It's one thing for the OC to contact you under the FDCPA, but the rules change when a third party is involved. Call the bluff. Demand an address and send a DV/C&D. Under the FDCPA, these folks are NOT the OC. F**K em.
