Getting out of a lease???

If we end up not filing and we work something out with the bank, is there anyway I can get out of a year lease I just signed for an apartment?

I'm fairly certain we're still going to file, I just want to know in case the attorney recommends we stay in the house. I doubt he will since he already told us that we should get rid of it. Is there any benefit to the attorney for having us to this? Is there any benefit to the attorney if we are forced to wait and file a Ch. 13 under the new plan?

Have you moved in to the apartment yet? If you haven't taken possession, you may just be out your security deposit. Check the paperwork that you have signed for cancellation information.

Yes, I have moved some stuff in, but I have not spent one night there yet. Does this matter? I did transfer the electric to my name, though. I just read the lease and there isn't any information about cancellation.

If you took possesion (have a key and moved things in) then its technically an occupied apartment.
