Worried that I am to have to file pro-se by Friday!!

Had final meeting with attorney week and half ago. Signed papers (with minor changes to be made by attorney), paid attorney fee & filing fee in full (checks have cleared). She said case would be filed by mid-week (that would have been Oct 4,5,6).

My problem (first of all, I am a terrible worrier).... but I cannot get ahold of attorney. Left a couple messages with no response. Sent email, no response. Just want to know that my case is FILED prior to deadline!

Have check Pacer (several times daily since last week) and no sign of me there either!

What should I do to prepare myself for filing pro-se at the last minute?

Any advise would be greatly appreciated!!

I would go to the Attorney's Office. While most Attorneys work in your favor some may be looking at filing after the deadline in order to complicate things and increase fees.

That being said, do not assume that your lawyer is trying to do this. Best thing is to go and speak to the secretary or Attorney in person, it could at least put a little fire under them.

Ask to see the file with the timestamped documents from the courthouse. It is forward and you may feel funny asking, but it's your BK in the balance and your peace of mind. Also be aware that most Attorneys do filings in mid week, that is normal.

Thanks for the advice. Problem is the attorney's office is about 2 hours away... and also has a second office on the other side of the state. I doubt I would just be able to stop in.

I had a similar situation when I filed. I needed it to be filed by a certain day (before I got paid again). I was told that everything would be filed electronically. That wasn't good enough for me. I called and talked to someone else in the office. They were able to pull something to tell me that the paperwork had been filed. And it had been. It relieved my mind (finally). My suggestion is if you cannot get the attorney, talk to someone else in the office, a clerk or something. They should be able to tell you what you need to know. I hope this helps.
