My 341 was a total of 7-10 minutes. She raised questions about me having two cars, but I have three people in my household. I told it was a medical necessity for my disabled sister. She questioned me surrendering my old home and paying arrearages on my current one. Why did I purchase a home when I was having financial problems, well I wasn't having financial problems at the time. My financial problems started in July. She questioned me being an independent contractor, she said I was more like an employee than self employed. She didn't question much of anything else, except how will I deal with the balloon note on my current house in 2007. I can refinance it in Winter 2007 or late Fall 2006 after I have 12 on time payments, which I made 1, 11 to go.
The real estate contract holder came and didn't really know what to do. He wanted to give the trustee the Proof of Claim, he asked if I had insurance. He just wants the property maintained and insured (as far as I can tell). He was concerned about the balloon payment due in 2007. I explained to both of them about refinancing before that time. She didn't say anything, she just wrote the information down. The creditor didn't say anything. He seemed at a loss of what to do about anything.
Does it sound like she is going to object to my plan? I wanted to go to my 341 with my attorney but with the rush in filings before the deadline, I can't retain the one I want until october 24th. Or should I save the money and work it out on my own. If no one objects I can be confirmed in November which is what I want.
For others who have been through this, is there anything I should be on lookout for which could cause a problem.
