    Converting to Ch 7 after 7 months of non confirmed ch 13

    Boy oh Boy has it been a nightmare so far!!! We were trying to save our home and paying in 5500$ per month for the last 7 months and so far it has all went into a trust account and no dived out yet!

    Then we decided to give up our house due to the payment of 3800$ and now our attorney is converting us to chap 7 and using most of the funds we paid in mostly for the house payment to pay our irs bill of 22K and he seems to think we will get the differance back since we dont have any assets

    Does this sound right??? Anyone else done this before? Of course I am glad just becuase it would be over quickly but at the same time I am wondering how this will all play out!

    by the way I was laid off and that made this all possible income went from 6700$ per month to 3800$ and us having 455$ left over after bills and rent at our new place

    I have never converted to a chapter 7 but I do know that in an unconfirmed plan, the fees paid in will go to pay off your attorney and the trustee and then the rest is refunded to you. So if your attorney is using it to pay the IRS then yes, what he is saying sounds about right.

      Great!!! We shall find out this week they just sent 21890$ to the irs paying them off in full with 2890$ left as a balance which should be coming back to us now...

      Gotta love more attorney fees
