    how long in the state of MS do you have to wait to file a chapter 13 after filing a chapter 7

    Its not a state specific rule, more, a federal rule/law.

    You can't get a Chapter 13 "discharge" if you received a discharge in a previous Chapter 13 case in the last two years, or a discharge in a Chapter 7 case filed within the last four years. You aren't barred from filing for Chapter 13 bankruptcy in these circumstances, but you can't get the discharge until the requisite time has passed.

    For instance, you can file for Chapter 13 bankruptcy the moment you receive a Chapter 7 discharge ( to handle liens that survived your Chapter 7 case or debts werent discharged in that case ), but you won't get your Chapter 13 discharge until four years have passed since you file the earlier Chapter 7 case. (Filing for Chapter 13 after filing a Chapter 7 is known colloquially as a "Chapter 20 bankruptcy.")


    So go fill out your petition for your Chapter 13, but make sure it lasts for atleast 4 years, so that you can get the discharge.
