here they still been calling my parents house after i already had my BK hearing!
so i finally got the number and i called them back and are they a nasty bunch! i was nice and explained to the guy that i filed BK back in may and just had my hearing this last friday, he said he would close it out and when i asked if he wanted my case number he hung up. So i called back and got someone more nasty and he looked up my account and he goes its bankrupt, your case is closed, and i was trying to ask him if the calls were going to stop and he just goes its bankrupt and HU on me LOL.

and they never gave me the mini miranada warning.

Well, definitely a violation on a few fronts.

I wonder if the mini-Miranda is even required, though, since they are not legally entitled to be collecting in the first place.

I suppose the right lawyer, or an irritable bk judge, could turn this into cash.

oh yeah im sure it can, but as long as they stop calling my parents house ill leave it alone.

As I think I said before on this forum, these were the only guys who got me so worked up that I used every four-letter word I knew at them. The issue was the same: calling my parents. I called, asked for the guy who'd left a message and a fairly pleasant guy said "Let me see if he's in." He came back to the phone (still pleasant) and said "he's not in, but I can handle this" then it was like he switched to jerk mode, yelling at me, telling me "I don't have to do anything for you" when I asked for a mailing address. After cursing him out, I looked up contact information and overnighted a C&D letter. I guess they must think they're pretty special because the idiot who signed for the letter signed it "B. Luckie" -- what a bunch of jerks! And lovely that it's legal in this country for "people" like them to harass not only my senior-citizen parents but their neighbors too.
