    Bankruptcy & Utility Bills

    I filed Bankruptcy on 10/10/05. This week I received a letter from my electric company saying, if I didn't pay the past due amount by this Friday, my electricity would be turned off. I asked to speak to their department that handles bankruptcy and they said there was no way I could talk to them! After many, many tries, I got the same answer time after time. My account did not show any updates about filing Chapter 7, so I faxed them the documents yesterday and I called again today and they said my account still did not show anything. They said again there was no way I could contact the bankruptcy dept. to see about my bankruptcy papers! What can I do to prevent my electricty being turned off. I have tried averything in my power. Oh by the way I contacted the electric company, because my lawyer told me to. Any help would be so much appreciated!

    If you have an attorney, get him involved.

    If not, go in and talk to a manager, rather than dealing with someone by phone. By law, they can't shut you off but they can require a deposit & start billing you again from your file date forward. *I'm not sure how long you have that they can't shut off, it probably isn't for the entire BK stay.

      I also work for a utility company.
      By law when we are notified, we CANNOT disconnect service till after the client is discharged. After that we can charge a big deposit to keep their service on.
      Did you included the electric company in your creditors list??

      Since they want to be such A****, include them and get the debt wiped out...

      Did you ask about signing an extension with the utility company??

        By the way, you are expected to keep your utilities paid while in the bk process. Did your lawyer explain that too you??

        Just because you are filing BK doesn't mean you DON'T HAVE TO PAY ANYBODY...

        Best keep the utilities on because if their turned off the deposits will be large...

          We did the pro-rated bill thing about a year before filing, the bill is the same and each year will be reevaluated.
          I'll be watching, you may never know when or how, but I'll be there. I am there now....
