    Question about discharge...

    We are on day 62. I know I have to be patient. Anyway, before the UST withdrew his motion to dismiss the court set a date for a court hearing on the motion. He then withdrew his motion and it's on Pacer but the court date is still scheduled. My attorney said not to worry about it but will we still get discharged with the hearing pending?

    Should I call the clerk and ask or what? I told my attorney last week that I had received a notice from the court about the hearing and he didn't know what I was talking about and told me not to worry about it.
    4/09 Converted to a Ch 7 due to loss in dh's income
    5/09 UST now involved no idea what happens next
    7/09 UST has decided to withdraw his motion to dismiss!
    7/27/09 DISCHARGED!!!

    I would call the clerk and ask. You may be told that you need to talk with your attorney. If so, tell them that you did, and he/she knew nothing about a letter and a court date.

    You most likely will not have anything to worry about. When 'Hub and I were going to have to appear in court for our Adversary Proceeding, the date was set. But before that, we worked with the opponent's attorney to get the matter--an open lawsuit--put back to the state court where it belonged. The date was still there, but we did not have to appear as it was no longer relevant.
